Terms of Service for Hyperfocus Coach

Please read these Terms of Service ("Terms") carefully before using Hyperfocus Coach ("the App").

1. Acceptance of Terms

By downloading, installing, or using Hyperfocus Coach, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Hyperfocus Coach is a productivity and focus management application designed for individuals with ADHD. The App provides:

• Task Management: Create and track micro-goals and tasks
• Focus Sessions: Pomodoro-style focus timers with AI-powered coaching
• Gamification: XP, streaks, badges, and progress tracking
• AI Coaching: Personalized insights powered by Google Gemini API
• Voice Input: Speech-to-text for quick task creation

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities under your account
• You must be at least 13 years old to create an account

3.2 Account Security

• You agree to notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from your failure to protect your account

4. Acceptable Use

You agree to use Hyperfocus Coach only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the App or our systems
• Use the App to harass, abuse, or harm others
• Reverse engineer, decompile, or disassemble the App
• Use automated tools or bots to access the App
• Resell or redistribute the App or its content

5. Intellectual Property

5.1 Our Content

• Hyperfocus Coach and all its content (code, design, graphics, text) are owned by us and protected by copyright, trademark, and other intellectual property laws
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes

5.2 Your Content

• You retain ownership of all content you create in the App (tasks, notes, session data)
• By using the App, you grant us a limited license to process, store, and display your content to provide the service
• We do not claim ownership of your user-generated content

6. Subscription and Payments

6.1 Free Tier

• Basic features of Hyperfocus Coach are available free of charge
• We reserve the right to modify or discontinue free features at any time

6.2 Premium Subscription (If Applicable)

• Premium features may be offered via in-app subscription
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• Payment is charged to your Apple ID account
• Manage subscriptions in your Apple ID Account Settings
• No refunds for partial periods or unused features

6.3 Price Changes

• We reserve the right to change subscription prices at any time
• Price changes will be communicated in advance
• Continued use after price change constitutes acceptance

7. AI-Powered Features

7.1 AI Coaching Disclaimer

• AI coaching insights are generated by Google Gemini API and are for informational purposes only
• AI-generated content should not be considered professional medical or therapeutic advice
• If you have ADHD or other mental health concerns, consult with a qualified healthcare professional

7.2 Accuracy

• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• Use AI insights at your own discretion

Your use of Hyperfocus Coach is also governed by our Privacy Policy. By using the App, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

10. Third-Party Services

The App integrates with third-party services (Firebase, Google Gemini API, Apple Sign In). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or content.

11. Disclaimers and Limitation of Liability

11.1 "AS IS" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF NO PAYMENT)

11.3 Exceptions

Some jurisdictions do not allow limitations on warranties or liability. In such cases, the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hyperfocus Coach, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

13.1 Termination by You

• You may stop using the App and delete your account at any time
• Deleting the App does not automatically delete your account data (see Privacy Policy)

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity
• Discontinuation of the service

13.3 Effect of Termination

• Upon termination, your right to use the App ceases immediately
• We are not liable for any loss or damage resulting from termination
• Sections 5 (Intellectual Property), 9 (Privacy), 11 (Disclaimers), and 12 (Indemnification) survive termination

14. Changes to Terms

We may update these Terms from time to time. Changes will be effective:

• When posted in the App or on our website
• For material changes, we will provide 30 days' notice

Your continued use of the App after changes constitutes acceptance. If you do not agree, stop using the App and delete your account.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of [British Columbia, Canada], without regard to conflict of law principles.

15.2 Dispute Resolution

• Any disputes shall first be resolved through good-faith negotiations
• If negotiations fail, disputes shall be resolved through binding arbitration (if applicable in your jurisdiction)
• You waive the right to participate in class-action lawsuits

15.3 Exceptions

Nothing in these Terms limits your rights under consumer protection laws in your jurisdiction.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hyperfocus Coach.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.

16.3 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

16.4 Assignment

You may not assign or transfer these Terms. We may assign these Terms without restriction.

16.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, etc.).
